1. THE SERVICE
LeCoCash is an assistance app published by LeCoCash Inc., a Canadian company, Quebec, Canada. It prepares and dials for you the USSD codes of the MTN and Orange Mobile Money services, keeps the log of your operations and backs it up to your account.
LeCoCash is not a bank, a payment institution or an electronic money issuer: it holds, receives and transfers no funds. Operations are carried out solely by your operator, under the terms you accepted when you opened your Mobile Money account. LeCoCash is neither affiliated with nor endorsed by MTN or Orange.
2. ACCEPTANCE OF THE TERMS
These terms are available before you create your account, and at any time in Settings. By creating your account, you expressly accept them, together with the Privacy Policy, which forms part of them; the version accepted and its date are recorded with your account. Any use of LeCoCash also constitutes acceptance of the terms in force.
If you do not accept these terms, do not use LeCoCash.
3. YOUR ACCOUNT
To create an account, you must be of legal age and the holder, or an authorised user, of the phone line used. One account is allowed per number. The information you provide must be accurate.
Your LeCoCash code and, if you turn it on, your fingerprint protect the opening of the app: keep your code secret. LeCoCash will never ask for your Mobile Money PIN, which you only enter in your operator's menu. You are responsible for the use of your phone and must tell us without delay of any loss, theft or unauthorised use.
4. HOW IT WORKS AND BACKUP
Your operations go through your operator's network: they need no Internet connection. Internet is only used to create your account, log in again, back up your history and update the app.
As soon as your phone is online, your history is backed up to your account: by logging in on a new phone, you get your operations back. Operations not yet backed up when a phone is lost cannot be recovered. The LeCoCash log is a tracking tool: it does not replace your operator's statement, which alone is authoritative.
5. YOUR OPERATIONS
Before each operation, you check the recipient, agent or merchant, the amount and the operator. An operation is only carried out after you confirm it with your PIN, in the operator's menu. The result is given to you by the operator, on screen and then by SMS: LeCoCash does not receive it and does not guarantee it.
An operation confirmed with the operator is generally irreversible. Any claim (wrong recipient, disputed debit, refund) must be sent to your operator. Before launching an operation again from the log, make sure it has not already been carried out.
When you state that an Orange recipient has an OM Asso account, or choose to add the withdrawal fee, the app dials the code accordingly: you are responsible for the accuracy of these choices.
6. FEES
Using LeCoCash is free. Only your operator's fees and taxes apply.
The fees shown in the app, including the withdrawal fee you may choose to cover, are estimates based on the operators' public fee schedules: only the amounts charged by the operator are authoritative.
7. PROHIBITED USE
You may not use LeCoCash for any unlawful activity, including fraud, money laundering or terrorist financing, operate on behalf of a third party without their consent, attempt to bypass the app's security, or copy, modify or resell all or part of it. LeCoCash may suspend or close an account in case of prohibited use and cooperate with the competent authorities.
8. LIABILITY
LeCoCash is provided as is. LeCoCash uses reasonable means to keep it working properly, without guaranteeing continuous availability or the absence of errors.
LeCoCash is not liable for:
- operations carried out by the operator based on the information you confirmed;
- interruptions, delays or errors of the operators' networks and services;
- differences between estimated fees and the fees charged;
- the consequences of use that does not comply with these terms or of unauthorised access to your phone.
To the extent permitted by law, LeCoCash's liability is limited to direct, proven damage, excluding indirect losses. Nothing in these terms limits the rights the law grants you and that cannot be waived.
9. PERSONAL DATA
The processing of your data, the backup of your history and the production of anonymous statistics are described in the Privacy Policy, which forms part of these terms.
10. INTELLECTUAL PROPERTY AND TRADEMARKS
The app, its texts, design and code belong to the company LeCoCash, which grants you a personal, free and non-transferable right to use the app. The MTN, MoMo, Orange and Orange Money names and logos belong to their owners and are only used to identify the operator concerned.
11. TERM, SUSPENSION AND DELETION
You can delete your account at any time from Settings or by writing to us. LeCoCash may suspend or close an account for breach of these terms, after informing you, except in an emergency or where the law requires otherwise. LeCoCash may change or stop the service; if it stops, you will be informed at least 30 days in advance and can download your history.
12. CHANGES
LeCoCash may change these terms. You will be informed in the app at least 30 days before a significant change takes effect. If you refuse it, you can delete your account; continuing to use LeCoCash after that date constitutes acceptance.
13. GOVERNING LAW AND DISPUTES
These terms are governed by Cameroonian law. In case of dispute, contact us first to seek an amicable solution. Failing agreement within 30 days, the dispute will be brought before the competent courts of Douala, subject to the mandatory rules protecting consumers in their country of residence.
If the French and English versions differ, the French version prevails.
